The Pros and Cons of the Libel Defences of Justification and Fair Comment Essay Libel law in England is incredibly tough, so much so, that if found to be liable of a defamatory statement, ‘a statement which lowers someone in the eyes of reasonable people ’ [Quinn 2009: 210] the consequences can be very costly to both the journalist themselves and their newspapers and therefore it is very important for the defences of defamation to be used to full effect an example of this is libel tourism and the case of involving Roman Polanski 2005.The magazine had said that the event had take place before the claimant’s wife’s funeral, but it had in fact taken lace after the funeral, which Mr Polanski completely denied. As it could not be proved, the claimant won ? 50,000 in damages. There are seven different defences for the act of defamation, of which two of these, Justification and Fair comment, we will analyse the advantages and disadvantages below. For the defence of justification to apply, the defendant must prove that what they have written and published is substantially true. If this can be proved by the defendant then they will have a complete defence against the claims of defamation. The defence of justification may only be used where the defendant has published a statement of fact. One of the main disadvantages of the defence of justification is that the burden of proof relies upon the defendant, which means that they must prove what they have published to be true. Furthermore, the claimant does not have to prove that what you have written is false or that any fact found to be false was damaging to their reputation. Another disadvantage of this defence is that ‘A defendant cannot rely on the defence of justification in relation to the publication of the details of spent convictions, as efined by the Rehabilitation of Offenders Act 1974’ [1] This Act has been brought in to help with rehabilitation of offenders and prevents journalists from acting in a malicious manner when relating to cases of this nature. An advantage of the defence however is that the journalist does not have to prove that what they have published was in the public’s best interests and furthermore they do not have to prove that they acted in a malicious manner. A further disadvantage to the defendant is that any rumour they chose to publish must be backed up by evidence of the accusation made within the rumour. This means that the defendant cannot base their evidence alone on a previous rumour. However an advantage to the defendant comes by way of a case where the claimant alleges that more than one fact within a publication is untrue. In such a case, the defendant need not prove that all claims within the publication to be true and must only prove that ‘the ‘sting’ of a libel’ [Quinn 2009: 212] to be true. This suggests that only the most important allegations, which are damaging to the claimants reputation, need to be determined to be true. This can be seen in the case of Turcu News Group Newspapers, where the defendant was sued after publishing a number of defamatory statements including some which were found to be untrue. However the statement made that the claimant was a ‘petty criminal with a long list of convictions’ and that ‘he was willing to take part in criminal activities’ were true, and the defence of justification stood on the grounds that the sting of the statement remained true. A further advantage to the defendant is that ‘A claim of justification need not only be based upon facts as were known at the time of publication; if other facts come to ight during the period between a claim and the case coming to court, they can be used to back up the defence. ’ [Quinn 2009: 214]. This appeared in a case in which involved Kate Moss and Channel 5, where a documentary was claiming that Moss had taken cocaine on a photo shoot in Barcelona and fallen into a coma. Kate Moss sued channel 5, but during proceedings she was captured in pictures taking cocaine. Due to such evidence, Moss chose to drop her claim. A final disadvantage to any defendant involves the likely case where, the defendant uses the defence of justification and is unsuccessful. In such a case ‘an unsuccessful defence of justification is likely to increase the level of any damages awarded. ’ [2] In the case of Archer v News of the World (1987) the newspaper was successfully sued by archer after claims were made by the paper which they could not prove, this in turn resulted in a payout to Mr Archer of ? 500,000 damages. It was later discovered that the claims made about Archer were true and he was consequently imprisoned for perjury. This case is a clear example of a situation where the jury are start struck and are therefore biased in favour of the claimant. The defence of fair comment applies to cases where the defendant has been accused of publishing a defamatory comment or opinion. For the defence to apply, the defendant must prove that, the words complained of were a comment or opinion, not a statement of fact, the words were about a matter of public interest, any facts which the comment was based on are true, or subject to privilege and that the comment was made without malice and so was an honest belief of the defendant. The first and main advantage of Fair comment applies to a case where the defendant can prove that the statement made, was one of personal opinion and one hich they fully believe ‘to have been made honestly’ [Quinn 2009: 216]. This was shown in the case of Branson v Bower (No. 1) where the claimant tried to sue on the grounds that the comment made could be taken as statement of fact. The court of appeal disagreed, stating that it was clear that the statement published by the defendant was an opinion. Another advantage of this defence is that much like that of justification, the defendant must not prove that each of the facts in the publication to be true, as long as they can prove that those facts commented on were true. In the case of Galloway v Telegraph Group Ltd (2006) the defendants claimed that they had based opinions upon facts they believed to be true about the claimant. The defendants pleaded fair comment but this was refused by the court stating that ‘the stories were allegations of fact’ [Quinn 2009: 217]. Again, a disadvantage of this defence, much like that of justification, is that it is the defendant’s responsibility to prove that ‘the underlying facts are true. If he or she is unable to do so, then the defence will fail. ’ [3] This appeared in a case involving Gordon Ramsey, where the defendant during a review complained that some scenes within the show were staged. The defendant could not back up these claims and consequently had to pay ? 75,000 in damages. Another advantage to the defence of fair comment is that any person may be entitled to comment, when the subject in matter is of interest to the public, due to either interest or concern at a matter which could affect them or another. A disadvantage to the defence of fair comment is where the claimant can show that what has been published against them has been done so with malicious intent. In such cases the defendant will not be able to use the defence of fair comment. This was shown in the case of David Soul v Matthew Wright, where the defendant criticized the claimants acting without having been to see the show. As he had not been to see Mr Soul’s play he had no facts to base his criticism on and consequently had to pay damages. A final advantage of this defence is the definition of fair comment. It is stated that ‘even very rude and critical reviews can be covered by the defence of fair comment, so long as the facts on which they are based are true. [Quinn 2009: 220] this basically means that it must only be proved that the facts upon which the opinion is based upon must be true for the defence to be used. This was seen in the case of Tse Wai Chun Paul v Albert Chang, the courts stated that ‘even where a writer is motivated by ‘spite, animosity, intent to injure, intent to arouse controversy or other motivation’ they can be covered by fair comment’. [Quinn 2009: 219] In conclusion, I’d say that in both of the defences the claimant has the advantage. The first of these reasons is due to the burden of proof, which the defendant holds, nd in turn puts the claimant in a no lose situation. The second of these reasons is the possibility for further damage to the defendant in a case where they cannot prove their innocence. This leaves the defendant in a position where they must risk further detriment to prove their case. Also, and finally, where a defence fails, this can prevent the public from knowing information which may be within their [the public’s] best interests, which could subsequently harm the good of the public. Due to the many implications and faults of the law, it is soon to be changed.

In order to market Auckland, we are going to launch out Malaysia local foods, satay. Satay is a type of foods that are grilled or barbecued over a wood or charcoal fire, then served with various spicy seasonings. Satay is cheap and easily prepared if you are experienced worker. We are launching traditional satay which has six types of satay meat. Six types of satay meats that we launched out are mutton, beef, rabbit, deer, chicken, and fish. We will produce our own secret recipe that cannot be found in others place. It is use to attract the local market of Auckland. Our objective is to lets the foreigner experience new flavour and new sensation of Malaysia local food. In making consideration of the health issues, our satay is modified to be less oil, less calories and less fat. We will set up our own outlet that has traditional design of Malaysia style. Customers can feel the Malaysian culture when they come to our outlet. Waiter and waitress in our outlet are required to wear the custom of Malaysian style. The speciality of our outlet is customers are able to see the satay producing process. Besides that, online purchase service also available. Customers can either purchase satay directly from our outlet or indirectly by online booking. These make them more convenience. Delivery services are also provided and free of charge if it is within specific area. Price Price is one of the important issues in marketing mix that determine whether a product can be success or not. Price that we offer is following ethical issue. We are using penetration strategy to attract the customers. Difference types of satay meats are charge at difference prices. Customers can get special discount when they reach certain level of consumption. Low price but high quality of foods is provided. There is no price discrimination to end customer which is an illegal actions. Promotion Promotion efforts that we offered to local people of Auckland are include flyers, newspaper, free sample, cash vouchers, delivery services and weekly discount. If we can promote our products and outlet well, customers will automatically come to us. Flyers and newspaper are more economic ways to promote certain product. Due to we are relatively new in Auckland, we have to heavily promote our products and outlets to reach the sales. Free sample for testing are only available in the first three months of opening. The main objective is to understand the affect of those reasons on business or trade policy because external factors of a country are different within each others. Therefore, we should choose a suitable location to operate the business by viewing the analysis to ensure that the business has potential to enter the country. The country that we had chosen to analyse is in New Zealand which is Auckland. Our analysis is based on three main factors which are political and legal factor, economy factor and finally social and culture factor. Political and legal factor To run a business at other country, one of the important factors which affect trade policy is their legal rules, regulations and their government. Each of the worlds national government regulates trade and commerce with other countries and controls the access of outside enterprises to national resources. The operations and activities of the global enterprise, including the global marketers ability to address market opportunities and threats are affected by every countrys unique legal and regulatory system. The risk is lesser if the government is stable. This is because legal rules and regulations would not be change in short period. In Auckland, the risk of operating new business is high. This is because after every three year, the new government of New Zealand will apply new rules and regulations which benefit for an organization. So, although a business can going into the market in this year, but it does not meant that it can permanently set up at Auckland due to the new rules and regulations. Therefore, before our satay business is going in the market of Auckland, we need to analysis and do estimation on the rules and regulations of Auckland. This is to ensure our business can live longer at Auckland and can survive in Auckland market. Beside the risk of operate business, the labour force is very expensive in New Zealand. Due to the high labour force, we planned to assign some of the workers from Malaysia to operate the business in Auckland. This can save our operating expenses. The lending rate in New Zealand is high, company has to paid more interest. This situation could be good for the government but it might reduce the profit of a company. The capital of our satay business needs to be high to prevent lending money from government of New Zealand. Exporting a business to New Zealand is already high cost activity, if our business still needs to bare the high lending interest, it will be very hard to earn profits. This is because the profits had been used to pay the high lending interest. Thus, our business needs to have a large amount of capital to export the business to Auckland. Business freedom in New Zealand is 99. 9 % and trade freedom is 84.6 %. It meant that New Zealand has better environment to do business and trading. Therefore, we can easily bring our satay business into Auckland. Economy Factor Inflation rate is less in New Zealand. If inflation rate is low, every commodity and service such as labour, rice, sugar and others products will available at low price where as the organization can produce more. Therefore, we can buy the local products with a low price and fully utilized the resources to increase the productivity. By the lower price of resources, we can launch our business successfully because we need not to worry about the high operating expenses. We can spend our money in other activities that need more investment such as advertising. In New Zealand, people prefer to spend more to help carry on the circulation of money all over the country by buy capital goods, luxuries products and necessary products. This meant that they support their local products. They like to buy their own country product to help the economic growth. In this situation, we decide to buy mutton and beef from New Zealand. We will let our consumers know that our satay is made by the mutton and beef come from their own country. Since they are supporting local products, they will tend to support our satay that produced by local mutton and beef. Moreover, the unemployment rate in New Zealand is low. The citizen will have their own work. Therefore, they have purchasing power that allowed them to buy the products they like. The consumers will consume from the shop because they have money to consume products that they prefer. Our satay is not very expensive compare to local food. If the consumers found that our satay is much better than their expectation, the will consume more. Once the food is cheaper and delicious than other, the consumers can be attracted easily. Social and Culture factor Every country has different culture to each other. New Zealand has majority of Christians religion. According to the 2006 census, Christianity is the predominant religion in New Zealand, which have 55.6% of the population, another 34.7% had no religion and around 4% affiliated with other religions. The Christians have no much restriction about the food that take. Not like Muslims, they have more restriction on food. Therefore, the Christians can choose the food they prefer to have. Besides, the consumption and imports of foods and beverage and electronic gadgets will increase during festival like Christmas in New Zealand. This is because the Christians are concern on their special festival. They prefer cook some special foods and invite their relatives and friends to have a gathering. Education sector contributed 6.2% to New Zealand GDP. New Zealand is famous on education sector. Many foreign students are study English and mostly foreigner study in university at New Zealand. One of the famous universities in New Zealand is University Of Auckland. The floating population in Auckland is high due to the famous university. This is an opportunity for our business to launch in Auckland. The population is high and we can target on the students. Students always dare to try new things and they always search for new things to try. Thus, we can attract the students by promoting our satay to them. Furthermore, life expectancy rate is more and mortality rate is low in New Zealand. This is because their lifestyle is free and less stress, they do not like to stay in stressful life. They prefer leisurely lifestyle. After work, they would not think about the work again. They will clear their mind and enjoy their rest time. Thus, they like to do some leisure activities such as go for a walk in the park. One of the famous parks in Auckland is Albert Park. The Auckland citizen will visit to the park during their leisure time. Therefore, we can target on this group of people. What is the importance of Moira in the Margaret Atwood’s novel The Handmaid’s Tale ?

Moira is a strong character whose determination and past life experiences influence her actions within the new Gilead regime. Moira is undoubtedly a role model for the handmaids in the novel as she is brave and is motivated by her beliefs from which she developed even before the regime was introduced. Moira is also Offred's friend with whom she can associate comfort and trust. However, her determination for her own survival shows her to be selfish and dangerous. One of the underlying purposes of Moira in the novel is as a link to Offred's past. There are many occasions in the novel when Offred refers to her friendship with Moira before the regime: ‘There was a time we didn't hug after she told me she was gay, but then she said I didn't turn her on' Throughout the novel Moira is displayed as a flamboyant character, here, she willingly jokes about her sexuality in order to comfort Offred. She appears to be a complete contrast to Offred as she is bold and out-going, her language is vulgar and brash. Furthermore, the fact that she is allowed to be gay in society shows how much more freedom there was in a pre-Gilead culture. Moira is a clear role model for the handmaids, especially Offred. She displays exceptional courage and determination throughout her time at the Red Centre: ‘You can't let her go slipping over the edge. That stuff is catching' When Janine shows weakness in the Red Centre, Moira takes it upon herself to help her and make sure the Aunts don't find her like it. The fact she tells Offred how to help Janine shows Moira plans to escape. The escape from the Red Centre for the Handmaid's is a fantasy, and when Moira successfully escapes, she too becomes their fantasy. Offred is particularly impressed by Moira's actions and at one point states ‘ if I were Moira, I'd know how to take it apart' This shows Offred's respect for Moira, and suggests her will to be like her. However, Offred makes no attempt to act like Moira, as her disbelief in herself is too strong. Although Moira is caring and a good friend to Offred, her plans to escape the regime are entirely selfish: ‘I've got to get out of here, I'm going bats. I feel panic' Not only does Moira not consider Offred's panic when she tells her she wants to leave but she also implies her escape will be on her own and for herself. Moira's resistance could be a direct danger to Offred, as she is associated as her friend and could therefore be considered either as a source of information for Moira's whereabouts or as a rebel herself. Although Offred's intentions for Moira to stay may also be selfish, as Moira is her only companion, and brings about an air of protectiveness and hope, because she never shows fear and always seems to believe she will escape. The fact Offred finds Moira in Jezebel's hints she has been unsuccessful, as she has escaped to a place, which goes against herself and her ideals: ‘That shit you're with? I've had him, he's the pits' This quote shows she has slept with men, something she would not have been inclined to do in a pre-Gilead society, this clearly shows Moira is not a free woman. Moira is also wearing something she would not haven chosen freely, her out-fit is intended to make her look sexually attractive to men. This is something that Moira would have campaigned against before the new regime was introduced. The fact that Moira was unsuccessful makes her less of a role model in Offred's mind and her mistake was to be too determined. Moira acted on impulse and needed to seek a more powerful resistance than her. Offred's comfort she takes from Jezebels is maybe that the resistance she has discovered is her escape route. Offred now knows she can be successful without being Moira. So, Moira is a strong-minded politically aware woman. Her beliefs in feminism motivate her to resist the sexist regime she has been forced to comply with. Moira is a constant reminder of past life, as she represents freedom for women in a pre-Gilead and Gilead regime, although the sexism she now fights against is magnified in Gilead. Moira's determination is a contrast to Offred's, and her bravery is something, which all the Handmaids wish they had. Moira's heroine status makes her seem she can help any of them and they perceive her to be successful. However, in reality Moira has become a prostitute in Jezebel's. Moira has become something that symbolises what she has fought against mentally and physically throughout her life. Moira is an example in the novel of failed determination. She shows that Offred's subtle attempts to resist the regime and find others like her are not useless.

Paper Barn Burning, The New Social Order of the South Although many political and economic changes took place following the Civil War, it was very evident in William Faulkner’s Barn Burning that the impact on the social lives of the people living in the South were the most difficult to overcome. He utilizes the new tension between the social classes to create a compelling short story of a boy and his father, but more important, using the family to represent the change in society, the change between good and evil. The new social order after the civil war was a cause of tension between Abner Snopes and his surrounding communities. In William Faulkner’s Barn Burning Abner is portrayed as a man with much insecurity, which causes him to lash out at the people that were better off than he. His lack of prosperity and wealth leads him to be hostile towards the people wealthier than his family â€Å"‘I aim to. I don’t figure to stay in a country among people who†¦Ã¢â‚¬â„¢ He said something unprintable and vile. † (Faulkner 2) While Abner was not found guilty of arson the family is forced to leave on account of their own safety because of how the public viewed their family, â€Å"’Barn burner! † (3) shouts one of the other citizens, showing the reader how much Abner and his family are un-liked. However, his choices do not change how his son sees him, yet. Abner and his way of dealing with issues begin to take a toll on the family, and most of all his son Sardy. His excessive anger and violence begin to change how Sardy feels about him, and he starts to question if his fath er is a good role model. Sensing this, Abner decides to intervene before Sardy sees what kind of a man he really is and he begins to question whether following his father is the right thing to do â€Å"’You’re going to be a man. You got to learn. You got to learn to stick to your own blood or you ain’t going to have any blood to stick to you. ’† (5) Despite Abner’s efforts Sardy has already began to wonder about his dad’s character. At this point, Sardy realizes what kind of a man his father is and he decides to take his own path, even if that involves ratting out his own father â€Å"’Barn! ’ He cried ‘Barn! ’† Realizing that Abner is about to burn down another barn Sardy warns Major DeSpain. Thus breaking away from his father’s ways of life and choosing his own path, making sure he himself won’t venture down the same path Abner did. And hopefully be able to stay in one area for a prolonged period of time, making it possible for Sardy to better provide for his family. Abner is easily frustrated at the fact that his family must live in worse living conditions because he cannot provide for his family. He believes in the old ways of slavery, but now that he is beneath an African American in the DeSpain household he despises Major DeSpain and how he treats him and his family as if they are slaves. Abner feels as if he is beneath the African American population after the war, referring to his own family as slaves â€Å"’That’s sweat. Nigger sweat†¦ Maybe he wants to mix some white sweat with it’† (8). The Snopes’ quality of life is far worse than that of the African American butler in the DeSpain’s home. Because of Abners up-bringing in a racist time-period the thought of being below an African American angers him, especially when he is supposed to listen to what a black man tells him to do, â€Å"’Get out of the way, nigger. (7) Despite the new laws regarding slavery the overall attitude of Abner Snopes did not change towards blacks. It certainly did not help that the aristocracy found new ways to get their work done by victimizing poor families, and treating them almost as if they were slaves. Mr. Snopes despised Major DeSpain for treating him and his family un fairly, causing him to once again, attempt to burn down a bar n to get revenge for DeSpains wrongdoings to his family. Abner Snopes is contemptuous of the new ways of this country, refusing to accept the new order of doing things he decides to express his hatred through destroying of other people’s property. In William Faulkner’s Barn Burning he tells the reader of the devastating effects of the new social order of the South. Although many political and economic problems arouse resulting from the civil war the social effects on those living in the southern United States were the most evident in Faulkner’s short story Barn Burning.

Socrates illuminates the nature of the soul to Meno in 81b-c to help Meno understand his theory of recollection. He explains that because the human soul is immortal, it has seen all things, and there is nothing that the soul has not learned. Furthermore, he explains that since the soul has learned everything already, nothing prevents a man from recollecting those things. At Meno 81d, Socrates acknowledges the process of recollecting things as â€Å"a process that men call learning.† This theory of recollection forms a distinct difference between Meno and Socrates’ argument. At Meno 81e Socrates tells Meno â€Å"We must therefore, not believe that debater’s argument, for it would make us idle, and fainthearted men like to hear it, whereas my argument makes them energetic and keen on the search.† In other words, we can not believe in Meno’s debater’s argument because according to it, a man cannot learn anything new, and that is challenging to accept when it seems that men learn new things all the time. Instead, Socrates suggests we believe in his argument known as the recollection doctrine because it keeps men â€Å"energetic and keen on the search,† to recollect the things it new before. Meno seems to understand why they cannot believe in his debater’s argument and he also seems to understand Socrates’ recollection doctrine.
